Website Terms of Use
Effective Date: August 20, 2026
Last Updated: August 20, 2026
These Website Terms of Use (“Terms”) govern your access to and use of the Haskell Digital Services, LLC website, including its pages, articles, case studies, specialized website previews, downloadable materials, forms, and other public content.
By using this website, you agree to these Terms. If you do not agree, please discontinue use of the website.
1. About Haskell Digital Services
Haskell Digital Services, LLC (“HDS,” “we,” “our,” or “us”) is a Maine-based web design company serving clients remotely across the United States.
These Terms apply to use of the public HDS website. Paid services are governed by the service agreement, proposal, or other terms accepted by the client. If a service agreement conflicts with these Website Terms, the service agreement controls for that client relationship.
2. Eligibility
This website is intended for adults and businesses. By using the website, you confirm that you are at least 18 years old and legally able to agree to these Terms.
If you use the website on behalf of a business or organization, you confirm that you are authorized to act on its behalf.
3. Website Information
We work to keep the information on this website clear and current. However, website content may occasionally contain errors, omissions, outdated information, or technical issues.
Service descriptions, pricing, availability, timelines, included features, and examples may change. Information displayed on the website does not modify an existing client agreement unless HDS and the client agree to that change in writing.
We may update, remove, restrict, or discontinue website content at any time.
4. Project Applications and Inquiries
Submitting a contact form or project application does not:
Create a client relationship
Reserve a project date
Guarantee availability
Require HDS to accept the project
Create an obligation for either party to proceed
Replace a service agreement or required payment
A client relationship begins only after the applicable agreement has been accepted and any required initial payment has been completed.
Information submitted through our forms is handled according to our Privacy Policy.
5. Service Agreements
Purchasing or enrolling in an HDS service may require you to accept a separate agreement.
The Out-of-the-Box Web Design service is governed by the Out-of-the-Box Service Agreement presented before checkout. Custom Web Design and E-commerce Web Design projects are governed by the agreement prepared for the applicable project.
Those agreements may address matters including:
Project scope and deliverables
Payment and recurring billing
Client responsibilities
Content and feedback deadlines
Revisions
Website and content ownership
Hosting, domains, software, and third-party costs
Ongoing website management
Cancellation and termination
Disclaimers and limitations
These Website Terms do not replace those agreements.
6. Intellectual Property
Unless otherwise stated, the HDS website and its original content are owned by Haskell Digital Services, LLC or used with permission. This includes:
Website layouts and visual presentation
Written copy
Graphics and design elements
Logos and brand materials
Specialized website designs
Photographs and videos owned or licensed by HDS
Articles, guides, and educational content
Case-study writing and presentation
Code and custom styling created for this website
These materials are protected by copyright, trademark, and other intellectual-property laws.
You may view the website and share links to public pages for personal or legitimate business reference. You may not copy, reproduce, republish, sell, license, redistribute, scrape, modify, frame, or commercially use HDS content without prior written permission.
You may not present HDS content, designs, case studies, or specialized website previews as your own work.
7. Client Brands and Third-Party Materials
Client names, logos, photographs, trademarks, testimonials, and other client materials remain the property of their respective owners.
Portfolio examples and case studies may include work owned by a client, collaborator, employer, or other third party and displayed with permission. Inclusion on this website does not transfer ownership to HDS or to website visitors.
Some projects may have been completed through another company or collaborative arrangement. Where applicable, the case study will identify that relationship and the scope of HDS’s or an individual team member’s contribution.
8. Testimonials and Project Results
Testimonials reflect the personal experiences and opinions of the individuals who provided them. They do not guarantee that another client will receive the same experience or result.
Case studies describe specific projects, decisions, deliverables, and outcomes. Results vary based on the business, industry, market, client participation, content, budget, competition, third-party platforms, and other circumstances.
9. No Guarantee of Business or Search Results
Website design, development, copywriting, search setup, and related services may support a business’s online communication and visibility. HDS does not guarantee:
Search-engine rankings
Inclusion in AI-generated answers
Website traffic
Leads or inquiries
Conversion rates
Sales or revenue
Business growth or profitability
Continued performance on a third-party platform
Search engines, AI systems, social platforms, software providers, browsers, and other third parties may change their systems without notice. HDS does not control those changes.
10. Acceptable Use

14. Disclaimer of Warranties
To the fullest extent permitted by law, this website and its public content are provided on an “as available” and “as is” basis.
HDS disclaims warranties concerning the website’s accuracy, completeness, availability, fitness for a particular purpose, merchantability, noninfringement, security, or results.
Nothing on this website constitutes legal, financial, tax, or other regulated professional advice. You should consult an appropriately qualified professional when you need that type of advice.
Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
15. Limitation of Liability
To the fullest extent permitted by law, HDS and its owners, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of—or inability to use—this website.
This includes losses involving data, profits, revenue, business opportunities, goodwill, or third-party services.
Where liability cannot legally be excluded, HDS’s liability arising from use of the public website will be limited to the amount you paid HDS specifically for access to the website, if any.
This limitation applies only to use of the public website. Liability related to a paid service is governed by the applicable service agreement.
Some jurisdictions do not allow certain liability limitations, so portions of this section may not apply to you.
16. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless HDS and its owners, employees, contractors, and representatives from claims, losses, liabilities, damages, and reasonable expenses arising from:
Your unlawful or unauthorized use of the website
Material you submit
Your violation of these Terms
Your violation of another person’s rights

We may remove or restrict disputed material while reviewing a claim.
19. Changes to These Terms
We may update these Website Terms when our website, services, or legal obligations change.
The revised Terms will be posted on this page with a new “Last Updated” date. Updated Terms apply to website use after publication. They do not retroactively change an existing client agreement.
20. Governing Law and Venue
These Terms are governed by the laws of the State of Maine, without regard to conflict-of-law rules.
To the extent permitted by law, disputes arising solely from use of the public website will be handled by the applicable state or federal courts serving Kennebec County, Maine.
21. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. An unenforceable provision will be limited or modified only as much as necessary to make it enforceable where permitted.
22. Waiver
A delay or failure by HDS to enforce a provision does not waive the right to enforce it later.
23. Entire Terms
These Terms, together with the Privacy Policy, constitute the agreement between you and HDS concerning use of the public website.
They do not replace a service agreement governing paid work.
